Temporary Increase in Work Hours for International Students

Generally, most study permit holders are authorized to work off-campus on a part-time basis (20 hours per week) during an academic session. This includes an ability to work on a full-time basis during regularly scheduled breaks (e.g., summer holidays).

Under Immigration, Refugees and Citizenship Canada’s (IRCC) new temporary public policy, most study permit holders are now permitted to work more than 20 hours per week during an academic session between November 15, 2022 and December 31, 2023, if they meet the eligibility criteria.

Restoration of Temporary Resident Status

If a temporary resident has lost their status (section 47 of the Immigration and Refugee Protection Act [IRPA]) or let their authorization to work or study expire, they may apply to restore that status in accordance with section 182 of the Immigration and Refugee Protection Regulations (IRPR).

It is important to note that since status and authorization are not the same under the IRPA, an applicant can only restore their status to that of a temporary resident and to the authorization that they held immediately prior to the restoration application. As an example, a student who lost their status cannot apply to restore temporary resident status with authorization to work.

Under this temporary public policy, we are introducing measures so that eligible PGWP holders can apply for a new open work permit that would be valid for up to 18 months. This public policy will be in effect until December 31, 2022.

Expert Comments: Canada Study Permit Financial Sufficiency

Students are required to demonstrate financial sufficiency for only the first year of studies, regardless of the duration of the course or program of studies in which they are enrolled. In other words, a single student entering a four-year degree program with an annual tuition fee of $15,000 must demonstrate funds of $15,000 to satisfy the requirements, and not the full $60,000 which would be required for four years. Officers should be satisfied however that the probability of funding for future years does exist (i.e., parents are employed); scholarship is for more than one year. Applications for extensions made to CPC-E must also meet this requirement.

Canada is expanding the number of international students granted permanent resident status, while also making it easier for foreign PhD students to gain status through a new federal immigration initiative announced Wednesday.

The announcement was welcomed by Dennis Yim, a Korean international student who wants to stay in Canada after he graduates next month from Vancouver Community College.
