2021 LMIA: Hire Seasonal Agricultural Farm Worker

The purpose of the employment contract is to specify each party’s rights and obligations. It also allows ensuring that all parties understand and agree to the working conditions and their respective responsibilities. In the event that differences arise between the employer and the TFW, the contract will guide the resolution of disputes. The parties may contact the Ministry of Labour in the event:

  • of demonstrable breaches of the employment contract, and
  • where no resolution, including possible compensation, has been made

2021 Amendments to the Seasonal Agricultural Workers Program Employment Contract with Mexico
Note: This document is intended to provide a summary of the amendments to the above-mentioned employment contract. All parties are encouraged to review the appropriate employment contract in its entirety to remain informed on applicable terms and requirements.
The following sections and clauses of the Seasonal Agricultural Workers Program Employment Contract with Mexico have been amended for the 2021 Season:
1.  Section I: Scope and period of employment, Clause 4
This clause clarified that only unnamed workers are subject to a trial period of 14 working days.
2.  Section II: Lodging, meals and rest periods, Part A, Clause 1 and new 2
This clause clarifies that accommodations must continue to abide by applicable authorities. New wording in clause 2 specifies that the employer is responsible to provide transportation to and from off-site accommodations.
3.  Section II: Lodging, meals and rest periods, Part A, Clause 5
The permitted amount for utility deductions increased 1.28% (Consumer Price Index) to $2.36 for the 2021 season.
4.  Section V: Health and safety of workers, Clause 5
This clause increases the deduction amount for non-occupational medical coverage to $1.05 per day per worker for the 2021 season.
5.  Section VII: Travel and reception arrangements, Clause 5
The maximum airfare deductions were updated for the upcoming season.
6.  Section IX: Obligations of the worker, Clause 1
This clause clarifies the obligations of the worker by removing the wording that the worker agrees to work “at all times”.
Modificaciones 2021 para el Contrato del Programa de Trabajadores Agrícolas Temporales (PTAT) con México
Nota: Este documento tiene como objetivo ofrecer un resumen de las modificaciones del contrato de trabajo antes mencionado. Todas las partes deben revisar el contrato de trabajo pertinente en su totalidad para estar informadas acerca de los términos y requisitos que se aplican.
Las siguientes cláusulas del Contrato del Programa de Trabajadores Agrícolas Temporales con México han sido modificadas para la temporada 2021:
1.  Sección I: Alcance y período de empleo, Cláusula 4
Esta cláusula aclaró que solo los trabajadores no identificados están sujetos a un período de prueba de 14 días hábiles.
2.  Sección II: Alojamiento, comidas y períodos de descanso, Parte A, Cláusula 1 y 2 (nueva)
Esta cláusula aclara que los alojamientos deben seguir cumpliendo con las autoridades correspondientes. La nueva redacción en la cláusula 2 especifica que el empleador es responsable de proporcionar transporte hacia y desde los alojamientos fuera del sitio.
3.  Sección II: Alojamiento, comidas y períodos de descanso, Parte A, Cláusula 5
El monto permitido para deducciones por costos de servicio se incrementó un 1,28 % (índice de precios de consumo) a $2,36 para la temporada 2021.
4.  Sección V: Salud y seguridad de los empleados, Cláusula 5
Esta cláusula aumenta el monto de la deducción por cobertura médica no ocupacional a $1,05 por día por empleado para la temporada 2021.
5.  Sección VII: Organización del viaje y del recibimiento, Cláusula 5
Se actualizó el monto máximo permitido para deducciones por costos de tarifas aéreas para la nueva temporada.
6.  Sección IX: Obligaciones del trabajador, Cláusula 1
Esta cláusula aclara las obligaciones del trabajador al eliminar la redacción de que el trabajador se compromete a trabajar “en todo momento”.

Transfer of seasonal agricultural workers

Employers can transfer a worker from one farm to another, provided the employer has:

  • the worker’s consent
  • prior written approval from the foreign government representative in Canada
  • prior written approval from ESDC/Service Canada

The transfer provision is included in the employment agreements for workers from:

  • Mexico
  • participating Caribbean countries
