  • YES
    • Will the candidate be working more than 30 days?
      • ΝΟ
        • Short term exemption under Global Skills Strategy
      • YES

so another important question to ask as an employer is does the foreign worker need a work permit as indicated if the need for foreign worker is temporary or immediate you can support the temporary foreign worker to apply for a work permit while there are some exceptions for

global talent to enter canada without a work permit for the majority of workers in the early childhood educator field a work permit will be required and just to note that under the global skill strategy workers in that knock o which is professional or those are managerial or a professionals may enter canada without a work permit for a short term work of up to 30 days in a um in a calendar year

next slide please so once it’s determined that a work permit will be required then the next

question is which program should i use to support a foreign worker to apply for a work permit now there are two different pathways to obtaining a work permit in canada one is the temporary foreign worker program and the other is the international mobility program the temporary foreign worker program can be considered a measure to fill temporary skills and labor shortages in canada in this program employers must obtain a labor market impact assessment from employment and social development canada to hire the foreign workers now the second way to get a work permit is through the international mobility program
this program supports talent attraction and economic growth and does not require employers to obtain a labor market impact assessment before hiring a foreign worker and that um the reason why canada has these lmia exemptions is because the work that falls in this program brings either social cultural or economic benefit to canada and the next slide please

Work permits: International Mobility Program

Labour Market Impact Assessment (LMIA) EXEMPT

  • Step 1 – Employer: Determine LMIA exemption
  • Step 2 – Employer: Create Offer of Employment in Employer Portal (IRCC)
  • Step 3 – Worker: Apply online (IRCC) or on arrival (CBSA) for work permit

Cost: $230 Employer compliance fee + $155 work permit fee +
$85 biometrics fee = $470

so let’s talk a little bit more about the temporary foreign worker program again this is a program that falls under the jurisdiction of esdc employment and social development canada so this program allows employers in canada to hire a foreign worker when no canadians or permanent residents are available a positive lmia from esdc indicates that there are no canadians available to do the job and that there is a need for a foreign worker and here’s a quick summary of the steps and costs associated with the temporary foreign worker program so the employer needs to pay a thousand dollar fee per position and then the employee pays a hundred and fifty dollar a 455 dollar fee for their work permit the employee is also responsible for the biometrics fee and in total there is a cost of twelve hundred and forty dollars for um a work permit under the temporary foreign worker program the temporary foreign worker is also required to provide their biometrics which is their fingerprints and their photos and it’s important to note that a medical exam is required for immigration purposes for workers in child care and educational settings and so that’s an important distinction that you need to be aware of is that under the ece all workers would require a medical exam for immigration purposes

Work permits: Examples of LMIA Exemptions

Youth Exchange Programs

  • International Experience Canada
    • Working Holiday
    • Young Professionals
    • International Co-op Internship
  • Provincial/Territorial Agreements
    • Provincial & Territorial Nominees
  • International Agreements
    • Professionals
    • Technicians
    • Intra-Company Transferees
    • Contractual Service Suppliers
  • Significant Benefits
    • Entrepreneurs
    • Mobilité Francophone
    • Intra-Company Transferees

so now we’ll talk a little bit about the international ability program this falls more under the jurisdiction of ircc and this program supports talent attraction and economic growth to be eligible for a work permit which is exempt from the lmia requirement foreign workers must demonstrate that their work will result in significant or reciprocal benefits to canada under this program employers need to use the employer portal to submit the offer of employment information and pay a 230 dollar employer compliance fee and then they must give the offer of employment number which we often refer to as an a number um to the employees so they can submit their work permit so just to note around the employer portal um as an employer you would need to go in you need to register an account um in the employer portal and that’s where you put in all the information around your job offer to the individual
